Privacy Policy: By using the Platform, you also agree to our Privacy Policy, which describes how we collect and use your information, including location data.
Welcome to LockAtlas! LockAtlas Corporation ("LockAtlas," "we," "us," "our"), a Delaware corporation, operates the LockAtlas mobile application and website at lockatlas.com (collectively, the "Platform"). LockAtlas is an on-demand marketplace connecting customers with independent, licensed locksmith technicians in New York City. By creating an account, accessing, or using the Platform, you ("Customer," "you," "your") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Platform.
1. Eligibility and Account Registration
You must be at least 18 years old and legally capable of entering into binding contracts to use the Platform. By creating an account, you represent and warrant that all information you provide is accurate, current, and complete.
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately at support@lockatlas.com of any unauthorized use or security breach.
2. Platform Description and Technician Relationship
LockAtlas is a technology platform that connects customers with independent locksmith technicians ("Technicians"). LockAtlas does not employ Technicians, perform locksmith services, or control how Technicians provide services. Technicians are independent contractors who set their own schedules and operate their own businesses.
When you request a service through the Platform:
- You submit a service request with location and service details
- Our AI-powered system matches you with available, licensed Technicians
- You receive an upfront price estimate and technician information
- The Technician performs services directly to you as an independent contractor
- All services are subject to verification of your identity and authorization to access the property or vehicle
3. Pricing, Payments, and Fees
Transparent Pricing
You will always see the total price before confirming a booking. The total price consists of:
- Service Fee: Our platform fee based on the time your request is made (see below)
- Labor Costs: Technician fee for labor and parts (determined by our AI pricing system)
- Additional Parts or Services: Any additional parts or services discovered on-site (must be approved by you before work begins)
Service Fee Schedule
Our service fee varies by time of day and day of week:
Weekday (Monday–Friday):
- 8:00 AM – 7:00 PM (Business Hours): $40
- 7:00 PM – 9:00 PM (Evening): $50
- 9:00 PM – 11:00 PM (Late Night Premium): $70
- 11:00 PM – 8:00 AM (Overnight Emergency): $90
Weekend (Saturday–Sunday):
- 8:00 AM – 7:00 PM (Weekend Day Availability): $60
Weekend evening, late night, and overnight fees follow the same schedule as weekday evening, late night, and overnight rates listed above.
Payment Processing
All payments are securely processed through Stripe, Inc. ("Stripe"). By using the Platform, you agree to Stripe's terms of service available at stripe.com/legal. We do not store your complete payment card information. You authorize us to charge your payment method for all fees incurred.
Tips
Tips are 100% optional and go directly to the Technician. LockAtlas does not take any portion of tips.
4. Cancellations, No-Shows, and Refunds
Customer Cancellations
You may cancel a service request at any time before a Technician is dispatched at no charge. Once a Technician has been dispatched and is en route, cancellation fees apply as follows:
- After dispatch (Technician has completed 50%+ of travel): 50% of the service fee
- After dispatch (Technician has arrived at your location): 100% of the service fee
Customer No-Shows
If a Technician arrives at the scheduled location and you are not present or do not respond within 10 minutes, you will be charged the full service fee.
Refund Policy
If you are unsatisfied with services performed by a Technician, please contact us at support@lockatlas.com within 48 hours of service completion. We will investigate and may issue a partial or full refund at our sole discretion. Refunds are limited to the service fee paid to LockAtlas and do not include labor or parts costs paid directly to the Technician unless the Technician agrees to a refund.
5. Identity Verification and Property Access
For your safety and to prevent fraud, Technicians may request proof that you are authorized to access the property, vehicle, or item requiring locksmith services. You agree to provide:
- Valid government-issued photo ID
- Proof of residence (utility bill, lease agreement, etc.) for property access
- Vehicle registration or title for automotive locksmith services
- Any other reasonable documentation to verify authorization
Technicians reserve the right to refuse service if you cannot provide adequate proof of authorization. In such cases, you will only be charged the applicable cancellation fee, not the full service cost.
6. Technician Licensing and Insurance Verification
All Technicians on the LockAtlas platform must maintain:
- A valid New York State locksmith license (where required by local law)
- General liability insurance with minimum coverage of $1,000,000
- Current background checks renewed annually
- Workers compensation insurance or valid exemption
We verify these requirements before onboarding and periodically thereafter. However, we do not guarantee the quality, timeliness, or legality of services provided by Technicians.
7. Your Responsibilities and Prohibited Conduct
As a Customer, you agree to:
- Provide accurate location, contact information, and service details
- Be present or provide authorized access at the scheduled service time
- Treat Technicians with respect and professionalism
- Not request or solicit services outside the Platform to avoid fees
- Not share account credentials with others
- Not use the Platform for any illegal, fraudulent, or harmful purposes
- Not attempt to manipulate ratings, reviews, or pricing
Violation of these responsibilities may result in immediate account suspension or termination without refund.
8. Platform as Technology Service; Disclaimer of Warranties
LOCKATLAS IS A TECHNOLOGY PLATFORM THAT CONNECTS CUSTOMERS WITH INDEPENDENT TECHNICIANS. WE DO NOT PROVIDE LOCKSMITH SERVICES, EMPLOY TECHNICIANS, OR CONTROL HOW TECHNICIANS PERFORM SERVICES.
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT TECHNICIANS WILL PERFORM SERVICES TO YOUR SATISFACTION.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, LOCKATLAS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOST PROFITS, DATA LOSS, OR SERVICE INTERRUPTIONS, ARISING OUT OF OR RELATED TO YOUR USE OF THE PLATFORM OR SERVICES PROVIDED BY TECHNICIANS.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM YOUR USE OF THE PLATFORM IS LIMITED TO THE TOTAL SERVICE FEES YOU PAID TO LOCKATLAS IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.
THIS LIMITATION APPLIES EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
10. Indemnification
You agree to indemnify, defend, and hold harmless LockAtlas, its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable attorneys' fees) arising from: (a) your use of the Platform; (b) your violation of these Terms; (c) your violation of any rights of third parties; or (d) services provided by Technicians.
11. Dispute Resolution and Arbitration
Informal Resolution
If you have a dispute with LockAtlas, please contact us at support@lockatlas.com. We will attempt to resolve the dispute informally within 30 days.
Binding Arbitration
If we cannot resolve the dispute informally, you agree that any dispute arising from these Terms or your use of the Platform shall be resolved through binding arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules. The arbitration shall take place in New York County, New York.
Class Action Waiver
YOU AGREE THAT DISPUTES WILL BE RESOLVED ON AN INDIVIDUAL BASIS ONLY AND NOT AS A CLASS ACTION, CONSOLIDATED ACTION, OR REPRESENTATIVE ACTION. YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.
Exception for Small Claims
Either party may bring an individual action in small claims court if the claim qualifies.
12. Governing Law and Jurisdiction
These Terms are governed by the laws of the State of New York, without regard to conflict of law principles. Any disputes not subject to arbitration shall be resolved exclusively in the state or federal courts located in New York County, New York.
13. Modifications to These Terms
We may update these Terms from time to time. We will notify you of material changes by email or through the Platform at least 30 days before the changes take effect. Your continued use of the Platform after changes become effective constitutes your acceptance of the revised Terms.
14. Account Termination
You may close your account at any time by contacting support@lockatlas.com. We may suspend or terminate your account immediately without notice if you violate these Terms or for any other reason at our sole discretion.
15. General Provisions
- Entire Agreement: These Terms constitute the entire agreement between you and LockAtlas regarding your use of the Platform.
- Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force.
- Waiver: Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.
- Assignment: You may not assign these Terms without our prior written consent. We may assign these Terms at any time.
